General Legal Confidentiality Framework At EU level, statistical confidentiality is addressed in the following texts: - Council Regulation (EEC, Euratom) No 1588/90 on the transmission of data subject to statistical confidentiality to the Statistical Office of the European Communities; - Council Regulation (EC) No 322/97 on Community statistics; - Commission Decision 97/281/EC on the role of Eurostat as regards the production of Community statistics; - Commission Regulation (EC) No 831/2002, concerning access to confidential data for scientific purposes; - European Statistics Code of Practice

  3. Commission Regulation 831/2002 The Regulation sets out procedures under which access to confidential data for scientific purposes may be granted. It refers to: • European Community Household Panel (ECHP) • Labour Force Survey (LFS); • Community Innovation Survey (CIS); • Continuing Vocational Training Survey (CVTS); EU-SILC (Community Statistics on Income and Living Conditions - has its own Regulation 1177/2003, but follows also provisions of Regulation 831/2002, dissemination expected in 4/2006)

  4. Commission Regulation 831/2002 • Aims to give access to pan European datasets in a centralised and efficient way • Procedures required lot of investment (administrative and/or logistic) • Current improvements • Bilateral agreement between Eurostat and MS for fast track procedures. Operational hopefully in 5/2006 and will result in a reduction of access delay from 10 to 4 weeks) • Introduction of other surveys (e.g. SES, possible dissemination start end of 2006/beginning of 2007)

  5. Issued contracts 2005 • ECHP: 19 contracts and 6 amendments • LFS: 6 contracts (dissemination started in 6/2005) • CVTS: 1 contract

  6. Official access requests received from 1/1/2006-3/4/2006 • ECHP: 8 contracts and 1 amendment • LFS: 8 contracts and 2 amendments • CIS: 8 contracts (dissemination started in 2/2006)
