  2. Overtime pay is 1½ times the employee's regular rate of pay. So what is it?

  3. Managers/Supervisors “50% Rule” -> What is it? <- i.e: Gerard works for a taxi company, as both a taxi driver and dispatch. Working as a taxi driver he is not eligible for overtime pay. When he works as a dispatch he is. He works 26 hours in the office, and 24 hours driving a cab. -> And that means? <- (24+26=55) • Managers and supervisors are not able to get overtime because the work they do is managerial or supervisory, • Even if they preform other kinds of tasks that are exempt from the managerial/supervisory categories, they do not. -> Why? <- Eligibility -> Who else is eligible? <-

  4. Averaging Agreement. Weekly Basis -> What is it? <- i.e. Regular pay: $12/hr. Overtime rate: $18/hr (12 x 1.5 = 18) Therefore the employee must be paid $18/hr overtime. “Over a longer period under an averaging agreement” -> What is an averaging agreement? <- • i.e: Agreed Period: 4 weeks. Entitled Overtime: 176 hrs. (44x4=176) How is it Calculated?

  6. Do you have one? What is it? It is called ‘time off in lieu of overtime pay’, or an agreement to average hours of work for overtime pay purposes. • Yes. However, said employee cannot agree to Give up his right too overtime pay under the ESA. The employee is still entitled to overtime. ->And….<- What is my alternative?

  8. Most workers, public and private, are entitled to take the day off with regular pay. However, some employers may require employees to work on such a holiday, but the employee must either receive a day off in lieu of the holiday or must be paid at a premium rate – usually 1½ known as "time and a half" or twice known as "double time" the regular pay for their time worked that day, in addition to the holiday • In most provinces, when a statutory holiday falls on a normal day off (generally a weekend), the following work day is considered a statutory holiday.   9. If a holiday occurs on a day that is normally not worked, then "... another day off with pay will be provided. There are some exceptions, however. In Alberta, an employee is not entitled to compensation if a holiday falls on a non-work day. • When New Year's Day, Canada Day, Remembrance Day, Christmas Day or Boxing Day falls on a Saturday or Sunday you would not normally work, you are entitled to a holiday with pay on the working day immediately before or after the holiday. If one of the other holidays falls on a weekend, then your employer must add a holiday with pay to your annual vacation or give you a paid day off at another mutually convenient time.   10. 2014 is not a leap year so holidays that aren't observed on the same day of the week each year move one day forward, which means that Christmas this year will be on a Thursday and Boxing Day on a Friday! This makes vacation planning much easier for most of us. • Halloween - although not a stat holiday - is an exciting time of the year and it's on a Friday this year: trick or treaters can stay out a little later! • Canada Day is a Tuesday this year. This means that probably half the country will take Monday off to make this into a four-day long weekend! • Thanksgiving in 2014 is on October 13. • Easter in 2014 is fairly late on April 21 (Easter Monday), which makes for a nice and warm egghunt hopefully.
