Article 2: Executive Branch • Powers of the President (Section 2-Clause 1) • Commander in Chief-head of the armed forces • May get advice from heads of executive departments—today called the Cabinet • May grant pardons and reprieves • Reprieve-suspend punishment ordered by law • Pardon—prevent prosecution for a crime/ overrides the judgement of the court • Powers of the President (Section 2 Clause 2) • With a 2/3 vote in the Senate • Make treaties with other nations • Appoint people for the following positions: • Ambassadors, public ministers, consuls, judges of the Supreme Court, all other offices of the US

Executive Branch—Article 2, Section 2 • Reprieve—suspend punishment ordered by law • Pardon—overrides court decision/ prevents prosecution for a crime • Since 1977—Presidents have received about 600 requests a year • Normally grant around 10% • Most famous Ford’s pardon of Nixon (before even charged) • Washington pardoned people involved in the Whiskey Rebellion • Andrew Johnson pardoned thousands of Confederate soldiers after the Civil War • Jimmy Carter granted amnesty to Vietnam-era draft dodgers Only can be applied to US Federal Law Governors can pardon for state offenses

Today there are 15 • Newest Cabinet Office: Homeland Security • Secretary of State—4th in line for the President—was Hillary Clinton, now is John Kerry • Interior---nation’s resources, preserving its scenic and historical landmarks, water supply, Nationals Parks and Forests • Treasury—coining and printing money, money laws • Justice—chief legal officer of the US/ federal courts/ represents US in all legal matters • State—foreign affairs • Defense---defending our nation against all invaders/ armed forces • 3. Head of Cabinet Departments are called Secretaries, except Department of Justice=Attorney General • 4. The word Cabinetis NOT in the Constitution. The Constitution states President can get advice from “Executive departments.” • Washington in 1789 created the first Cabinet—5 original positions
