MADDE 19EN AZ İKİ FARKLI TAŞIMA ŞEKLİNİ KAPSAYAN TAŞIMA BELGESİ Çok şekilli taşıma belgesi yükleme yerinden boşaltma yerine kadar tüm yolculuğu kapsamakta ve böylece deniz, kara, hava gibi her bir taşıma güzergahı için ayrı bir taşıma belgesi düzenlenmesine gerek bulunmamaktadır. Sadece yükleme limanı ve boşaltma limanı sahaları doldurulduğunda ise limandan limana taşımayı kapsayn bir okyanus konşimentosu haline gelebilirler.

  2. a. En az iki farklı taşıma şeklini kapsayan bir taşıma belgesi (multimodal veya combined taşıma belgesi), nasıl adlandırılmış olursa olsun, İbraz edilen belge, “Multimodal Transport Document”, Combined Transport Document”, “Bill of Lading for Port-to-Port shipment and Combined Transport”, “Intermodal Bill of Lading” gibi başlıklar taşıyabilir. i.taşımacının ismini göstermeli ve, Belgenin antetinde bir firma ismi yeralması ayrıca “carrier” ifadesi yoksa o firmanın taşımacı olduğun dair bir kanıt değildir.

  3. taşımacı veya taşımacı adına ismi belirtilen bir acente tarafından, veya • kaptan veya kaptan adına ismi belirtilen bir acente tarafından, imzalanmalıdır. Taşımacı, kaptan veya acente tarafından atılan herhangi bir imza taşımacıya, kaptana veya acenteye ait imza olarak tanımlanmalıdır. Bir acente tarafından atılan herhangi bir imza o acentenin taşımacı veya kaptan adına imza attığını belirtmelidir. Kaptan adına imza atan ismi belirtilen bir acentenin kaptanın ismini belirtmesine gerek yoktur.

  4. ii. malların akreditifte belirtilen yerde sevk edildiğini (dispatched), teslim alındığını (taken in charge) veya gemiye yüklendiğini (shipped on board) belirtmelidir. Bu eylemler, • matbu bir kayıtla gösterilebilir, veya • malların sevkedildiği, teslim alındığı veya gemiye yüklendiği tarihi belirten bir kaşeyle veya kayıtla gösterilebilir.

  5. Taşıma denizden başlıyorsa “shipped on board”, karadan/havadan başlıyorsa duruma göre ”taken in charge/received, dispatched” gibi ifadeler yer olmalıdır. Taşıma belgesinin düzenlenme tarihi ‘dispatch’, ‘taking in charge’ veya ‘shipped on board’ tarihi ve yükleme tarihi olarak alınacaktır. Ancak taşıma belgesi kaşeyle veya kayıtla bir “dispatch’, ‘taking in charge’ veya ‘shipped on board’ tarihi belirtiyorsa bu tarih yükleme tarihi olarak alınacaktır.

Taşıma belgesi gemiyle, yükleme limanıyla veya boşaltma limanıyla ilgili olarak ‘intended’ veya benzer nitelikte bir kaydı içerse bile, akreditifte belirtilen sevk (dispatch), teslim alma (taken in charge) veya yükleme (shipment) yeri ile akreditifte belirtilen nihai varış yerini belirtmelidir.

Question Credit calls for: Clean on board combined transport document 44A:ANKARA (An inland place) 44B:PARIS, The presented document : Received type combined transport document showing ANKARA as place of receipt and PARIS in the place of delivery field. There is a date of issue on the document and an on board notation. In this case: 1-Must the on board notation be dated? 2-If it must be dated, must it include also ANKARA? Answer   The on board notation should be dated, whether it requires the insertion of Ankara will depend on whether the transport document indicates any information in respect of a named port of loading.

Question Credit requires: Multimodal transport document. 44A:Turkey 44B: China The presented received type multimodal transport bill of lading indicates the place of receipt as Ankara, port of loading as Izmir port and port of discharge as Shanghai. The document is dated 01.09.2009. , The document also contains an on board notation indicating loading on board in Izmir, vessel X on 05.09.2009. In respect of the facts stated above, which date will be taken as the shipment date? In my opinion, because of the wording of sub-article 19 (a) (ii) of the UCP "however, if the transport document indicates, by stamp or notation, a date of dispatch, taking in charge or shipped on board" the date stated within the on board notation i.e., 05.09.2009 must be taken as the date of shipment.

  22. Answer   The answer to your question actually lies in sub article 19 (a) (ii) where it states "indicate that the goods have been dispatched, taken in charge or shipped on board at the place stated in the credit". The credit did not specifically require that the shipment commence from a port in Turkey, therefore receipt of the goods in Ankara would represent the goods having been "taken in charge at the place stated in the credit". The date of such receipt would be considered to be the date of shipment i.e., 1 September 2009. The shipped on board date would only be applied where Izmir was stated to be the 'place stated in the credit'.

  23. Question   A credit indicates the following: Field 44E: TURKEY and field 44F: ZHONGSHAN. Documents Required: 3/3 set of combined transport documents (3/3 originals FBL) made out to order of .... . A negotiable FIATA Multimodal Transport bill of lading is presented. The document shows: Place of Receipt: ATATURK AIRPORT, ISTANBUL, TURKEY, Ocean Vessel: ... (blank), Port of Loading: HONG KONG, Port of Discharge and Place of Delivery as ZHONGSHAN. The document bears a date of issue and contains, in preprinted wording, "The goods instructions are accepted and dealt with subject to the Standard Conditions printed overleaf" and "Taken in charge in apparent good order and condition, unless otherwise noted herein at the place of receipt for transport and delivery as mentioned above."

  24. 1. I understand that the vessel's name is not necessary as per paragraph 68 of ISBP 681. Please advise. 2. As the first leg of the journey is by air, is a notation that the goods are accepted for carriage to be added on the document and, if so, whether this has been achieved by the first of the pre-printed clauses mentioned above. 3. As the first leg of the journey is by air, in my view the pre-printed wording "Taken in charge..." and the date of issuance of the document are sufficient. Please advise.

  25. Answer (1) You are correct. (2) It is not necessary under article 19, but the wording you quote does serve that purpose. (3) The wording 'taken in charge ..' is sufficient and the date of issuance of the document will be deemed to be the date of shipment (absent any notation on the transport document giving the flight number and date).

  26. MADDE 20KONŞİMENTO Konşimentonun sırasıyla üç önemli niteliği ve tanımı: I. Malların deniz yolu ile taşınacağını bildiren gemi sahibini temsil etmeye yetkili kişilerce imzalanan ve yükletene (shipper) veya acentasına verilen bir alındıdır.( receipt). II. Taşıma sözleşmesini (contract of carriage) ihtiva eder (belgenin arka kısmında) ve malların mülkiyet hakkını (title to the goods) temsil eder. Bu nedenle kıymetli evraktır.

  30. Açıklama: Yukarıdaki (a) (ii) 2.bullet pointte belirtildiği gibi matbu yazı “Received....” olduğundan belgede tarihli bir yükleme kaydı (on board notation) yer almalıdır. Bu yükleme kaydının tarihi (02/01/XXX) yükleme tarihi olarak alınacaktır.

  31. UCP500’ün 23.(a) (ii) fıkrasının son paragrafında yer alan, belgenin akreditifte belirtilen yükleme limanından farklı bir teslim alma yeri belirtmesi durumunda akreditifte belirtilen yükleme limanını ve yüklemenin yapıldığı geminin ismini gösteren yükleme kaydının (on board notation) konşimentoda yer alması şartı yeni 20.maddede yoktur. Ancak yukarıda altı çizili kırmızı renkte belirtilen eklentiler ve değişiklikler (akreditifte belirtilen yükleme limanında ismi belirtilen bir gemiye yüklendiğini göstermesi) yapılmıştır:

  36. Açıklama: Yukarıdaki örnekte konşimentonun düzenlenme tarihi olan 01.01.XXXX değil, sonradan eklenen “Shipped on Board” kaydının tarihi olan “31.12.XXXX” yükleme tarihi olarak alınacaktır. Konşimento geminin ismiyle ilgili olarak “intended vessel”veya benzer nitelikteki bir ifadeyi içerdiği takdirde yükleme tarihini ve yüklemenin fiilen yapıldığı geminin ismini belirten bir yükleme kaydının bulunması gerekir.

  39. iii. akreditifte belirtilen yükleme limanından akreditifte belirtilen boşaltma limanınayapılan sevkiyatı göstermelidir. Konşimento akreditifte belirtilen yükleme limanını yükleme limanı olarak göstermediği veya yükleme limanıyla ilgili olarak “intended” veya benzer nitelikteki bir kaydı içerdiği takdirde akreditifte belirtilen yükleme limanını, yükleme tarihini ve geminin ismini belirten bir yüklemekaydının bulunması gerekir. Bu hüküm ismi belirtilen bir gemiye yükleme (loading on board / shipment) yapıldığının konişmentoda matbu yazıyla belirtilmiş olması halinde dahi uygulanır.

  44. Akreditifi aktarmayı yasaklasa bile yukarıdaki gibi mallar konteyner, treyler veya LASH mavnalara yüklenerek aktarma yapıldığında da taşıma yine tek bir konşimento kapsamında olmalıdır. d. Bir konşimentoda taşımacının aktarma yapma hakkını saklı tuttuğunu belirten ibareler dikkate alınmayacaktır. Question   LC issued by Bank A required the presentation of a bill of lading consigned to the order of Bank A and that the notify party was also to be Bank A. The bill of lading is presented as follows: Consignee: to the order of Bank A Notify: same as consignee Is this correct or not? Answer   By inserting "same as consignee" in the notify party field, the bill of lading is indicating that Bank A is also the notify party. The document would be acceptable.

  45. Question   A credit requires shipment to be effected from "Xingang, China" with the port of discharge as "Busan, Korea". The bills of lading are presented showing Port of Loading: XINGANG without indicating the country China; Port of Discharge: BUSAN without indicating the country Korea. Is the document acceptable? Answer   Absence of the country names would not create a conflict with the terms and conditions of the documentary credit, when the bill of lading is read in context with the credit and the applicable rules of UCP 600. The document would be acceptable.

  46. Question Credit indicates "FULL SET" Bill of lading …… - Bill of Lading does not indicate the number of originals issued. In the absence of this information, we will not be in a position to ascertain whether a FULL SET has been submitted or not. In such an situation, can this be constituted as a DISCREPANCY? Answer   Sub-article 20 (a) (iv) of UCP 600 requires that the bill of lading be the sole original bill of lading or, if issued in more than one original, be the full set as indicated on the bill of lading. If the bill of lading does not indicate the number of originals that have been issued, a bank should refuse for the reason "bills of lading do not indicate the number of originals that have been issued".

  47. Question   L/C called for Port of Discharge as Chittagong. B/L presented shows Port of Discharge as Chittagong CY. Is additional CY appearing in port of discharge field acceptable ? Answer   On the basis that a port of loading, for example, showing Chittagong with a place of receipt as Chittagong CY is considered to be the same place, I would apply the same rationale here that Chittagong and Chittagong CY are considered to be the same place and therefore not a reason for refusal.

  48. Question   If a bill of lading indicates the name of the port of discharge required by the credit within its pre-printed box 'Intended port of Discharge' is such a bill of lading acceptable or, in this circumstance, for it to be acceptable there must be a separate additional notation thereon indicating the port of discharge as required by the credit. Answer   In any shipment by sea, the port of discharge is considered 'intended'- whether stated or not. There is no way the carrier can determine, before the ship sails, as to whether there will be events occurring that will stop them unloading at the port of discharge. The document would not need a notation to be added and would be acceptable showing "intended port of discharge".

  49. Question   Within the signature space on the bill of lading, it states "ABC COMPANY, CARRIER" and underneath "DEF COMPANY AS AGENT" without the mention of "FOR THE CARRIER" or "FOR THE MASTER" and their signature appears. ISBP681 paragraph 94 states that "If an agent signs a bill of lading on behalf of the carrier, the agent must be identified as agent and must identify on whose behalf it is signing, unless the carrier has been identified elswhere on the bill of lading". In my view the provisions of article 20 of UCP is clear to the effect that the agent must indicate whether it is signing for the carrier or for the master and the bill of lading is discrepant. Answer   You are correct, the agent must state that they are signing as agent for the carrier or as agent for the master.

  50. Question   A bill of lading indicates in pre-printed wording, within the designated box for the paragraph reading in part "Received for shipment....", that "IN WITNESS WHEREOF TWO (2) original Bs/L have been signed, if not otherwise stated above, one of which being accomplished the other(s) to be void." However, in the top right hand corner, under the preprinted wording "Number of Original Bs/L" by typewriting "3/THREE" appears. Is this a conflict and the document is discrepant or the typewritten text controls over the pre-printed wording and the bill of lading should be accepted in this respect?
