Okaloosa BCC Letter to Rep Dave Murzin • Response to request for additional ideas regarding legislative relief for military communities • Complements HB 7129 “Military Support” • Infrastructure Concurrency • Recent revisions continue to overlook burden on local communities experiencing rapid expansion of military presence • Communities need time to accommodate BRAC-related traffic into local CMS
Request concurrency relief in Growth Management Act – grace period to allow ambient development w/o hold up by development activities directly tied to BRAC • § 163.3180 (5) F.S. would have added subsection (h) – 3-year period proposed • Large-Scale Comp Plan Amendments • GMA exempts amendments associated w/military compatibility, though language is ambiguous w/BRAC-related growth • Affordable housing; add’l commercial areas near new concentrations of personnel, etc.
Revise §163.3187(1) F.S. to expand exemptions to the twice-yearly restriction for amendments needed to support BRAC-attributable growth • 163.3187(1)(m) – A comprehensive plan amendment that addresses criteria or compatibility of land uses adjacent to or in close proximity to military installations and comprehensive plan amendments needed to support growth directly attributable to Federal Base Realignment and Closure legislationin a local government’s future land use element does not count toward the limitation on the frequency of the plan amendments. • Incentives for Defense Communities to comply with military compatibility requirements in §163.3177 F.S.
Defense Grant Eligibility Prioritization • Impact Fee Waivers • Other Potential State Program Eligibility Prioritization • Prioritization of REPI/Florida Forever Funding • Density Transfers/Bonuses • Tax Credits • Goal is to not further penalize non-compliant communities; the intention is to “reward” those communities that have complied to make them more competitive for the programs mentioned above
Florida Building Code (§553.73 F.S.) • Permitting certain types of buildings/structures on Federal property • 553.73(9) The following buildings, structures, and facilities are exempt from the Florida Building Code as provided by law, and any further exemptions shall be determined by the Legislature and provided by law: (a) Buildings and structures specifically regulated and preempted by the Federal Government. Off-base structures to which the general public will have daily, unrestricted access will not be considered as specifically regulated or preempted by the Federal Government unless a specific regulation or exemption is provided.
Permanent (regional) facilitation entity • JLUS/GMP identified need for entity to facilitate long term viability of military installations • Liaison between defense communities’ elected officials & installations’ leadership • Clearinghouse for land use planning & development decisions • Forum for identifying, resolving military growth and compatibility issues • Sponsor for Federal aid programs & grants • Independent Special District (Ch 189 F.S.)
