De-Mobilization • Know Your Job is Protected • You have rights under the Uniformed Services Employment and Reemployment Rights Act (USERRA) • USERRA provides employment and reemployment rights and prohibits workplace discrimination • USERRA applies to all members of the uniformed services in a federally funded duty status • USERRA does not apply to members of the National Guard serving on State active duty, self-employed individuals, partners or college students

  3. De-Mobilization • Know your USERRA Requirements • Provided prior notice to your employer BEFORE you left • Served honorably while on active duty • Report back to work in a timely manner (see next slide for timetable)

De-Mobilization • Know When to go Back to Work Service TimeRequirement • 1-30 Days Report next work day, after safe travel home and 8 hours of rest • 31-180 Days Apply for reemployment within 14 days after release from service • 181+ Days Apply for reemployment within 90 days after release from service

De-Mobilization • Know Your USERRA Rights • Prompt reinstatement back into your job depends on the length of your deployment, usually about 2 weeks for a 90 day or longer deployment • Accumulation of seniority as if you never left entitles you to rights and benefits based on your length of service with your employer • Protection against discharge for a 181 day or longer deployment, your employer cannot discharge you, except for cause, for one year

De-Mobilization • Know Your USERRA Rights • Immediate reinstatement of health insurance without regard to pre-existing conditions, avoid accepting TRICARE in place of your health insurance • Training and retraining of job skills your employer must provide any training that you missed, includes accommodations for disabled • Protection against discrimination includes discrimination against employment, reemployment, termination, promotion and benefits

De-Mobilization • Recognize your Employer • Submit an ESGR award nomination form, available online at www.esgr.mil or in hard copy format • First level award is the ‘Patriot Award’, consists of a DoD certificate and a lapel pin • Other awards include; Above and Beyond, Pro Patria and the Secretary of Defense - Freedom Award
