  2. MEDIDAS PARA VIGILAR USO Y PROCEDENCIA LEGAL DE RG-ARTICULO 17- Medidas para vigilar y aumentar la transparencia sobre el uso de RG: • Puntos de verificación • Certificado de cumplimiento reconocido internacionalmente

  3. El fin de todas estas medidas: apoyar el cumplimiento Su adopción es obligatoria

  4. 1. PUNTOS DE VERIFICACION • Deberán nominar al menos uno • No hace mención a puntos de verificación específicos • Recibir o recoger información sobre CIF, fuente del recurso, CMA y/o uso del RG, según corresponda .

  5. 1. PUNTOS DE VERIFICACION cont… • El usuario de RG deberá presentar la información al punto de verificación designado. • Las Partes adoptaran medidas apropiadas, eficaces y proporcionales para abordar casos de incumplimiento.

PUNTOS DE VERIFICACION cont… • Informacion sobre CFP, fuente del recurso, establecimiento de CMA y/o uso del RG se proporcionara a las autoridades nacionales pertinentes, a la Parte que otorga el CFP y al Centro de Intercambio de Informacion sobre ADB. • La información debe ser pertinente y no confidencial

  7. 1. PUNTOS DE VERIFICACION cont… Deben ser pertinentes al uso de RG o a la recopilación de información pertinente, entre otras cosas, en cualquier etapa de investigación, desarrollo, innovación, pre- comercialización o comercialización.

  8. 2. CERTIFICADO DE CUMPLIMIENTO • El permiso o equivalente emitido al momento del acceso notificado al Centro de Intercambio de Informacion sobre Acceso y Participacion de los Beneficios del CBD. • Prueba que el acceso se ha dado de conformidad con el CIP y los CMA.

  9. 2. CERTIFICADO DE CUMPLIMIENTO cont… • Autoridad emisora y fecha de emisión • Proveedor • Identificador exclusivo del certificado • Persona o entidad que emite el CIP • Confirmación que se obtuvo el PIC y se han establecido CMA • RG cubiertos • Uso del RG
