Si differenzia dalla vendita perché lo scambio avviene in natura tra beni di analogo valore, senza che sia utilizzato il denaro. • Nonostante ciò, alla permuta si applicano le norme stabilite per la vendita, in quanto compatibili (art.1555). • L’oggetto deve essere determinato o determinabile (art. 1346) • La causa è costituita dallo scambio e dall’utilità
