MAASE Updates Discipline- a BIP is required if MDR finds behavior is a result of disability If FBA is part of evaluation, use REED Special Education transportation-suspended from bus doesn’t mean suspended from school. Is it a pattern of behavior, if continues to come to school, it doesn’t count as a suspension. Can a parent request a required member of the IEP team not attend an IEP. If the district believes the person needs to be there, the district has the right to have the person at the IEP. Autism Insurance Bill- More private providers making recommendations. No decline in requests for therapies May increase ASD evaluation requests Document in PWN any requests Must consider any outside evaluations
More MAASE Updates IEE’s for non public school students- can be provided to non public school students but there is no due process for non public school students Help for districts when parents & advocates want 10-12 hour IEP’s Use an agenda District has the right to offer FAPE, parents can disagree thru complaint process It’s the districts meeting! Move on, make parent move on Bring Prior Written Notice to the meeting, document in the notice form anything the district proposes or refuses to implement If parent chooses to leave, document time parent left, if possible, let parent know the IEP will continue, make sure you have parent input Don’t wait until day 364 to have the IEP!
Extended School Year You need to look at severity of disability and critical stages of development as well as regression/recoupment. For students who transfer from state to state, treat as an Initial IEP.
