ÁMBITOS DE EFICACIA • TERRITORIAL: • Eficacia frente actos lesivos realizados en extranjero por: • Particulares: • Ámbito penal: • Español • Intereses españoles relevantes para el Estado • Ámbito civil: orden público • Poder público extranjero: • Si ha recibido funciones del Estado español • Si se requiere de acto interno • Poderes españoles fuera España: respeto a DDFF • TEMPORAL: • Retroactividad en grado mínimo o medio

ÁMBITOS DE EFICACIA • PERSONAL: • Particulares: eficacia horizontal • Poderes públicos: eficacia vertical • EFICACIA VERTICAL: • Contenido: vinculación positiva a: • Contenido subjetivo • Contenido objetivo • DIMENSIÓN OBJETIVA: POLÍTICAS DE LOS DDFF • Medidas que eviten violación del DF • Medidas que favorezcan ejercicio DF • No convierte los DF en prestacionales: dependencia del tipo de política DECIDIDA por el Estado • Órganos: • Parlamento • Gobierno: PGE

  4. ÁMBITOS DE EFICACIA • EFICACIA VERTICAL: • DIMENSIÓN SUBJETIVA: GARANTÍAS • Judiciales: Protección mediatizada por: • Doctrina TC (delimitación) • Interpositio legislatoris (delimitación / limitación) • No judiciales: • Procesos no jurisdiccionales • Órganos de refuerzo de los DDFF

ÁMBITOS DE EFICACIA: EFICACIA HORIZONTAL • Regla general: • Vinculación negativa: no sujeción a la dimensión objetiva • Sólo nacen obligaciones (legales) cuando el legislador regula la dimensión objetiva • Libertad e igualdad • Teoría de la eficacia directa o inmediata: • Libertad e igualdad reales y efectivas • Conflictos se solucionan mediante regla de ponderación, debido a la igualdad entre particulares - PROBLEMA: delimitación DF en relaciones privadas

  6. ÁMBITOS DE EFICACIA: EFICACIA HORIZONTAL • Teoría de la eficacia indirecta o mediata: • Libertad e igualdad • Obligaciones sólo pueden derivar del desarrollo por el legislador de la dimensión objetiva - PROBLEMA: inactividad del legislador

ÁMBITOS DE EFICACIA: EFICACIA HORIZONTAL • Teoría de la eficacia directa matizada • Posición intermedia: • No hay dependencia absoluta del legislador • No todo el contenido del DF es oponible a particulares • Dependencia de: • Naturaleza del derecho • Relación intersubjetiva: • Cuanto mayor sea la asimetría, más eficacia directa (PUBLIFICACIÓN DE LA ESFERA PRIVADA)
