  3. KORRUPTIONSSTRAFRECHT (STRÄG 2008) 1) Öffentlicher Sektor (§ 304 – 308 STGB) - Begriffe „Amtsträger“, „öffentliche Aufgaben“ - Konnexität bzw „Anfüttern“ - Geringfügigkeit 2) Privater Sektor (§ 168 b – e STGB) - aktiv / passiv - nur Konnexität zu pflichtwidriger Handlung - Geringfügigkeit

BETRUG / UNTREUE - Befugnismißbrauch, Verletzung der Interessen des „Machtgebers“ (§ 146,153 STGB, § 10 UWG) - vielfältige Erscheinungsformen • ABSPRACHE IM VERGABEVERFAHREN - Bestimmung seit 2002 (§ 168b STGB) - kein Schadensnachweis notwendig • INTERESSENSKONFLIKT - Geschäfte mit Unternehmen in wirtschaftlichem Naheverhältnis zum Täter

TRANSPARENCY INTERNATIONAL www.transparency.org • Internationale Antikorruptionsorganisation • NGO (Nichtregierungs-Organisation) • 1993 von Prof. Dr. Peter Eigen gegründet • National Chapters in über 100 Ländern • Ziel: „Strengthening the national integrity system“ • Systemansatz, keine Einzelfälle • Erstellung von Indices (z.B. CPI)

TI / AUSTRIAN CHAPTER www.ti-austria.at - ist ein politisch und institutionell unabhängiger gemeinnütziger Verein • 2005 gegründet • Zusammenschluß namhafter Persönlichkeiten • Vorstand: Prof. Geiblinger, Dr.Bachmayer, Dr. Dallmann • Beiratspräsidium Dr. Fiedler, DDr Mayer, DDr. Sickinger • Vorstand und Beirat arbeiten ehrenamtlich • Diverse Arbeitsgruppen
